The conservative blogger in Philadelphia pens a memo to Democratic members of the U.S. Congress: “In my reading of the US Constitution I find no enumerated power delegated to either the Legislative or Executive branches of government to impose such a requirement. The Commerce Clause has been sighted [sic] as giving such power to the Congress under the guise on regulating economic activity in and among states, but the Constitution does not grant such blanket power. Under the Commerce Clause of the Constitution: ‘(The Congress shall have power) To regulate Commerce with foreign Nations, and among the several States, and with the Indian tribes’; this provision in no means gives Congress the power to mandate that individuals purchase health insurance and then fine or jail them for refusing to comply. The Commerce Clause gives Congress the power to regulate trade and the exchange of ‘goods’ between states, not to impose a healthcare plan upon me against my will. To imply that the Commerce Clause gives Congress the power to tax or fine ‘inactivity’, which is what refusing to buy health insurance is, implies that Congress has unlimited power to regulate the activity or inactivity of every citizen and Congress does not possess such authority.”
He continues his commentary: “I am opposed to this bill on the grounds that the special deals given to members of Congress in exchange for their vote violates the US Constitution, Article 1, Section 8 insomuch that it affords deals to some states that were not afforded to others. The Nebraska, Louisiana, Connecticut, North Dakota, Florida, and all other such deals are illegal under the US Constitution and any member of Congress voting for this bill is guilty of sanctioning and participating in illegal activity. I believe such deals are the equivalent to a bribe, and under Article 2 of the Constitution, Bribery is an Impeachable crime.”
More commentary from Mr. Greene: “The bill is composed of 10 years of taxes with 6 years of spending, and if the spending is properly calculated for the life of the bill, 10 years, not 6, the total cost of the bill rises to more than $2 Trillion and produces a $460 billion deficit in the first 10 years. This country is already facing a nearly $13 Trillion national debt with outstanding unfunded liabilities (Medicare, Social Security, etc.) of more than $76 Trillion, according to the GAO (Government Accountability Office); we simply cannot afford this Bill.”
